These terms and conditions govern your use of the web site and any contract between you and MDL Timber for the purchase of goods. By ordering goods from the MDL Timber web site you agree to be bound by these terms and conditions and agree that they constitute a legally binding contract between you and MDL Timber.

1. Definitions

"diyclick2buy.com" means MDL Timber (Address: 8-12 Denbigh Street, Liverpool, Merseyside, L5 9XT). MDL timber is owned by EA. stephens LTD. 37 Bankhall Street, Bootle, Liverpool, L20 8JD

"you" means any user of the web site

"goods" means any products available on the web site

"Agreement" means these terms & conditions

"working day" means Monday through Friday inclusive, except for public & bank holidays

"web site" means the web site accessible at the url http://www.diyclick2buy.com

"P&P" means postage and packing

2. Communication Via Email

2.1

You agree that all communications between MDL Timber and you can be made by email.

2.2

Unless otherwise expressly stated, any notices sent by email pursuant to the terms of this Agreement shall be deemed to have been made upon such email being sent.

2.3

Without prejudice to your rights and MDL Timber's obligations under relevant data protection laws, any personal information you send to MDL Timber via email is done so at your own risk.

2.4

By placing an order through this website, you are indicating your consent to receiving marketing emails from us.

3. Use of web site

3.1

MDL Timber reserves the right to withdraw the web site, any information contained in the web site, and any goods offered for sale on the web site, at any time in part or in whole without any prior notice.

3.2

You agree not to use the web site in any way which may cause degradation in performance of the web site or MDL Timber's computer systems or interruption to the web site's or MDL Timber's systems operation.

3.3

MDL Timber reserves the right to investigate your use of the web site for any reason whatsoever and report any suspected unlawful use of the site or fraudulent use of any credit or debit card or other payment method to relevant law enforcement authorities.

3.4

You are responsible for ensuring that use of this web site or any part of it is permissible in your jurisdiction. You agree that MDL Timber shall not be liable to you to the extent that any laws in your jurisdiction render MDL Timber's performance of its obligations under this Agreement unlawful.

3.5

You agree to fully indemnify MDL Timber for any claims, damages and costs, including legal fees, suffered by MDL Timber arising out of any misuse of the web site by you or any user of your computer equipment, whether authorised by you or not, or any misuse of the web site or your MDL Timber account information by any other user (except to the extent that such misuse arises from unlawful disclosure of your account information by MDL Timber to third parties).

3.6

You must be 18 years or older to use the web site and purchase goods offered for sale on the web site.

4. Offer To Purchase

4.1

An order placed by you through this web site will be considered as an offer to purchase goods from MDL Timber. Until your offer has been accepted in accordance with the terms of this Agreement, no contract for the sale of goods exists between you and MDL Timber and for the avoidance of doubt, prior to such acceptance, MDL Timber shall have no obligation to deliver any goods pursuant to your order.

4.2

On receipt of your order MDL Timber shall issue a confirmation email to confirm receipt of your order. This confirmation is of the order subject to terms 5.1 a/b.

4.3

MDL Timber reserves the right to refuse to accept an offer to purchase goods for any or no reason whatsoever.

5. Cancellation Of An Order By us:

5.1

We reserve the right to cancel the contract between us if:

a. We have insufficient stock to deliver the goods you have ordered and will not be receiving further supplies to go into stock, or we are unable to deliver to your area.

b. One or more of the goods you ordered was listed at an incorrect price due to  an error in the pricing information received by us from our suppliers.

c. If we do cancel your order we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

5.2

Cancellation of an order by you:

To cancel your order you must notify us in writing or email.

a. If you have received the goods before you cancel your order then you must send the goods back to our contact address at your own cost and risk. If you cancel your order but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

b. Once you have notified us that you are cancelling your order, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

c. Your right to cancel an order does not apply if the goods you have ordered are Made-to-Measure items.  

d. Re-stocking fees (5%) may apply (on larger sized goods/ products) when an order has been delivered/attempted delivery as per request and the order is cancelled without any notification. This is to the discretion of MDL timber.

6. Contract and title

6.1

A contract between you and MDL Timber for the purchase of goods will come into effect when all of the following conditions have been satisfied:

6.1.1 - you place an order through the web site or through the web site of one of MDL Timber's affiliates

6.1.2 - your order is not rejected by MDL Timber

6.1.3 - an acknowledgement email is sent to you to confirm your offer to purchase goods (see 5.1 a. for stock information) and to confirm receipt of payment for the goods. This is not an acceptance of the sale at this point.

 6.1.4 - Unless we have notified you that we do not accept your order or you have cancelled it in accordance with our terms and conditions, we will accept your order 7 days after the date of order or when the goods are delivered, whichever is earlier. 

6.1.5- All Special offers (eg Octimber) relating to discounts or free products on the site are to the discression of MDL timber and whilst stocks last. Offer are subject to change at anytime and MDL Timber can at any time change or ammend any offer without prior notice. Special offer products cannot be exchanged for another product or returned for a cash refund. Offers will only be available whilst stocks last and to the discretion of the management team @ MDL Timber.

6.1.6- Offers such as free delivery have a maximum value of £11. Free delivery is up to the maximum value of £11 when a spend value of £150 is completed, this will also include committing to a Facebook page 'Like'. Mdl timber can at anytime change and ammend this offer without prior notice. This offer will be available at limited times to our discrestion.

6.1.7- Free underlay offers on selected Laminate flooring will cover the amount of flooring needed up to a maximum value of £50 only. This offer only covers standard white foam underlay in our Octimber deal only. 6mm trend laminate does not exist in the Octimber deal.

6.2

MDL Timber shall arrange delivery of the goods to the address and the date specified by you in your order. You should make sure the goods can be received on this specified date. A signature will be required by a reasonable person over 18 years for the order. MDL timber can not be held responsible for the goods after this time. If a delivery date needs to be changed from the said date, this should be done via email at a minimum of 24 hours before the original date. If the delivery is made and cannot be completed for reasons beyond the control of MDL timber, the customer will be charged for another delivery plus a re-handling of stock charge to the discretion of the manager.

6.3

You pay in advance and in full for the goods prior to them being dispatched to you. MDL Timber will not charge your payment card until the goods are on MDL Timber's premises and allocated to your order.

7. Withdrawal from contract

7.1

You may not withdraw from a contract to purchase goods if you are buying the goods for business purposes or if they are intended for use or used for anything other than private or personal use.

7.2

You may withdraw from your contract for the purchase of goods from MDL Timber from the time it is made up to and including 7 working days from the day after you have received your goods (at its discretion MDL Timber may extend the number of working days).

7.3

MDL Timber will refund the full amount you paid for the goods within 30 days of your cancellation notice provided that you comply with your obligations in Clause 7.3 and 7.4 below. MDL Timber will not provide a refund if any packaging or seals on the goods have been broken.

7.4

To withdraw from a contract for the purchase of goods you must communicate this to MDL Timber by email (sent from yourself to) to sales@diyclick2buy.com, by telephone to 0151 207 7488 or in writing (by letter sent to MDL Timber's place of business) and you must specify the order number(s) to which the cancellation relates and full details of all items in respect of which you wish to cancel.

7.5

Once MDL Timber has read and accepted your request to withdraw from the contract MDL Timber will issue you with a returns authorisation and other instructions necessary for you to return the goods to MDL Timber (in the event that the goods have already been dispatched or delivered to you). You agree to comply with all such instructions and to take reasonable care to ensure that the goods are received by MDL Timber in undamaged condition. MDL Timber will not refund you if you do not take reasonable care to ensure that goods arrive undamaged and this results in non-delivery or damage to returned goods.

7.6

You will be responsible for bearing the cost of returning any goods to us where you cancel the contract in accordance with this clause 7 of the Agreement.

8. Price and Payment

8.1

MDL Timber reserves the right to change prices listed on the web site or price lists without prior notice.

8.2

The price you pay for goods is as shown on our web site at the time you order including postage and packing fees, where applicable.

8.3

A separate P&P charge may apply to goods and this will be shown on the web site.

8.4

MDL Timber accepts payment by cardsave online payment system. we encourage all customers to use the 3d secure online payment type which demonstrates all the correct anti-fraud technology, this encrypts your credit or debit card information to ensure your transaction with us is private and protected as it travels over the Internet .

9. Delivery of goods

9.1

Delivery of goods ordered by you will be made within 30 days after MDL Timber's acceptance of your offer by way of the acceptance notice. MDL Timber may at its discretion deliver the goods in separate consignments.

9.2

If MDL Timber judges that it will be unable to deliver the goods to you within the prescribed period, you will receive notification of the same and MDL Timber will provide you with a full refund, unless you agree an alternative delivery date.

9.3

If you do not receive the goods within 30 days of the acceptance notice, you must notify MDL Timber by email (to sales@diyclick2buy.com) within [30] days of the due delivery date. This notification must conform to the requirements specified by Royal Mail (a copy of which will be emailed to you after you notify MDL Timber of any goods not received.

9.4

If you do not receive the goods within the time limits set out above, and you notify us as required, we will refund the amount you paid for the goods or credit your MDL Timber account, unless we agree with you to resend the goods.

9.5

MDL Timber shall not be liable for any duties, customs or other taxes that may be imposed.

9.6

All deliveries by MDL Timber will be delivered to the nearest access point and would ask that you inform us if access is restricted at your selected address during the order process

9.7

Please make the correct provisions for the hand over of goods/ materials before arrival.  It is the duty of the buyer or his agent to make provisions for safe and dry areas for the delivery to be made.

9.8

Where the delivery is undertaken it should do so to the nearest access point.  If the customer requested the driver to deliver the goods into a property, the buyer should arrange for a clear access for goods before arrival.

MDL Timber takes no responsibility for any damage caused by the delivery of goods caused when asked to enter a property.

10. Returns

Faulty or incorrect goods

10.1

MDL Timber will replace any goods returned by you which when delivered were either damaged or did not conform to the specification stated on the web site, provided you notify MDL Timber in writing within 14 days of delivery of the goods to the address specified on your order. [You must send any goods back by registered post]

10.2

Goods will only be replaced after the original goods are returned. MDL Timber will not be liable for any goods that are not returned by you as required. MDL Timber will refund the amount paid by you for the goods or, if agreed with you, credit your MDL Timber account. MDL Timber will refund the reasonable costs associated with returning faulty or incorrect goods to MDL Timber. MDL timber can not be held responsible for any loss of funds through third parties ie. fitters or contractors for using a faulty product. (This may be taken up the said manufacture).

10.3

If you are not happy with your purchase for any reason you can return it to us and we will refund you with the amount you paid for that item less 20% re-stocking charge. However, this charge does not apply if the return is the fault of MDL Timber.

Returns must be made within 30 days of the purchase date and handles must be unused and in their original packaging. 

11. Liability

11.1

MDL Timber confirms that in relation to any goods purchased from the web site:
(a) MDL Timber has the right to sell the goods to you;
(b) the goods will correspond with the description given on the web site; and
(c) the goods will be of satisfactory quality (to the description used on the website).

11.2

MDL Timber excludes all other express or implied terms, conditions, warranties, representations or endorsements with regards to any goods. MDL Timber accepts no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect) however caused or whether foreseeable or not, arising from your purchase of goods on the web site.

11.3

MDL Timber's total liability to you under any contract for the purchase of goods or otherwise under this Agreement will be limited to the amount paid by you for any goods purchased.

11.4

MDL Timber will not be responsible for any loss or damages incurred by unauthorised use of your payment card on the web site. MDL Timber is not responsible for notifying your card issuer or any law enforcement authority in these instances.

11.5

The limitations and exclusions in this clause do not affect your statutory rights and only apply to the extent permitted by applicable law. Nothing in this Agreement shall serve to limit MDL Timber's liability for personal injury or death caused by negligence.

12. Force Majeure

12.1

MDL Timber shall not be liable for any failure to deliver or delay in delivery of the goods, or damage to goods delivered, arising from circumstances beyond MDL Timber's reasonable control.

13. Entire Agreement

13.1

The above represents the entire terms and conditions relating to your use of the web site to order goods and the supply of goods to you.. The terms and conditions can not be varied except as specified above.

13.2

These terms and conditions can only be varied in writing when signed by a director of MDL Timber. No additional terms or conditions requested by and communicated in any way by you will form part of the contract whether accepted or not by an employee of MDL Timber. No employee of MDL Timber can alter the terms and conditions of this contract whether or not they confirm this to you in any way.

14. Governing Law

This Agreement and any contract for the purchase of goods shall be construed in accordance with and governed by the laws of England & Wales.
